The products and services planned inventions have been invented, but in many cases, the need to improve a process or productivity growth has been the main reason for the invention. The products and services planned inventions have been invented, but in many cases, the need to improve a process or productivity growth has been the main reason for the invention. Once an item has been invented, the inventor must determine if it is beneficial to go through the process of obtaining a patent. A patent is a protected monopoly granted to the inventor of a product or a process. A patent carries the strongest protection of any registered intellectual property and monopoly lasts between 14 and 20 years depending on the type of invention. There are four requirements for a patent the inventor of a product must take into account before deciding whether to apply for a patent with the U.S. Patent and Trademark Office. The obligation to determine whether there is any aspect of the invention that are different is the most difficult hurdle to cross. Several years ago, I met a gentleman at a trade show who invented a life jacket, which I think was a great idea, because it was capable of reducing the weight of the lifejacket by 1.5 pounds. I believed in this product, so I decided to help secure funding and marketing the product. For more than six months, we visited the private and government agencies use life jackets to show the vest prototype of his invention. Although everyone seemed to like the product, there is no interest in buying the vest. After numerous meetings, I decided to find a diver to show him the vest. After looking over the vest, the diver said the fact that the vest was 1.5 kilos least it was not a motivating factor that would make buying a new jacket. The inventor of the vest was a guy who was diving holiday with friends and family from time to time, but does not cover the daily needs of a professional diver. For an occasional diver, 1.5 kilos lighter vest life was a great improvement, but not the people who dive for a living. Obviously, due diligence was not done by the inventor or me. The inventor decided to put the life jacket of a patent, but was denied. The inventors must have adequate knowledge about an industry and its products before they jump to the determination that a product or service is needed and ultimately survive in a commercial market. The inventor must make all necessary investigations to determine who thoroughly understands the needs of the industry in which it intends to market its new product. Once he believes he has exhausted all options in the understanding of their desired market, then the inventor must prove the product utilizing experts in the industry. Once these steps are taken to determine that there are aspects that are different from prior inventions and knowledge, the inventor meet the requirement of number 3 above. The inventor must then be confident in submitting a patent application.
